How to get state aid if you live with a person with a disability of group I or II due to a mental disorder

The Law of Ukraine "On Psychiatric Care" provides for the allowance for the care of a person with a disability of group I or II due to a mental disorder. The law establishes financial assistance to a person living with a person with a disability of group I or II due to a mental disorder who, according to the conclusion of the medical commission of a medical institution, needs constant third-party care, for the care of such a person.

The care allowance is calculated as the difference between three subsistence minimums for each family member and the average monthly total family income for the previous six months, but cannot be more than the subsistence minimum per person per month (from 01.01.2020 - UAH 2027, from 01.07.2020 - UAH 2118, from 01.12.2020 - UAH 2189).

Calculation of average monthly gross income

The calculation of the average monthly total family income for the purpose of granting the care allowance is carried out in accordance with the Methodology for calculating the total family income for all types of social assistance approved by a joint order of the Ministry of Social Policy, the Ministry of Finance, the Ministry of Economy, the State Committee for Youth and Sports Tourism, and the State Statistics Committee.

In addition, for individual entrepreneurs who have chosen the simplified taxation system and are single tax payers of Group I, regardless of the income received (not received), the total income for each month includes income equal to two amounts of the subsistence minimum established for able-bodied persons effective for the respective month. For groups II and III, income is taken into account in the amount of three and four sizes of the subsistence minimum established for able-bodied persons, respectively.

Who is a member of the family of the person applying for the care allowance

The family of the person applying for the care allowance includes

- spouse

- native, adopted and ward children of these persons, as well as children under the age of 23 who are enrolled in full-time vocational (vocational-technical), professional pre-university and higher education institutions and do not have their own families, regardless of their place of residence or registration;

- unmarried adult children who are recognized as persons with disabilities from childhood of group I or II or persons with disabilities of group I and live with their parents;

- disabled parents of a husband and wife who live with them and are dependent on them due to lack of their own income;

- a woman and a man who live in the same family, are not married, but have children together.

The family does not include persons recognized as persons with disabilities of group I or II due to a mental disorder, who, according to the conclusion of the medical commission of a medical institution, need constant outside care and do not belong to the above family members, and persons who are fully state dependent.

The period during which the allowance is paid

The care allowance is granted for six months and is paid on a monthly basis.

If a person who cares for a person with a disability of group I or II due to a mental disorder is an unemployed pensioner (person with a disability), he or she is granted a care allowance for 12 months on the basis of an application and a copy of the employment record book.

List of documents required to receive the allowance:

1. application

2. an identity document;

3. declaration of income and property status (filled in on the basis of income certificates of each family member) in the form approved by the Ministry of Social Policy;

4. a conclusion of the medical commission of a medical institution on the need for constant third-party care for a person with a disability of group I or II due to a mental disorder;

5. certificates on the availability and size of land plots allocated for personal subsidiary farming, gardening, haymaking, grazing, and land shares allocated as a result of land division;

6. a copy of the certificate to the medical and social expert commission's examination report issued to a person with a disability of group I or II due to a mental disorder who is being cared for.

Information on the applicant's family composition is indicated in the declaration of income and property status of persons applying for all types of social assistance.

The application form is approved by the Ministry of Social Policy, and the form of the conclusion on the need for permanent third-party care for a person with a disability of group I or II due to a mental disorder is approved by the Ministry of Health in agreement with the Ministry of Social Policy.

Who accepts documents and assigns benefits

The appointment and payment of care assistance is carried out by structural units for social protection of the population.

In rural areas, applications with the documents required for the granting of care assistance are accepted by authorized persons designated by the executive committees of settlement and village councils and transferred to the relevant social protection authorities.

- In the case of the formation of an amalgamated territorial community, applications with the necessary documents for the appointment of a care allowance are accepted by authorized persons designated by the executive bodies of the council of the amalgamated territorial community and transferred to the relevant social protection authorities.

Payment of the care allowance is terminated in the following cases

- there are changes in the family composition due to the death or change of residence of a person with a disability of group I or II due to a mental disorder or a person receiving care assistance;

- the period for establishing a group I or II disability has expired and the disability group that entitles the person to the care allowance has not been confirmed within a month;

- a person with a disability of group I or II due to a mental disorder is on full state support or inpatient treatment for a full calendar month.

In the event of circumstances that result in the termination of the payment of care assistance, the persons receiving the assistance are obliged to notify the authorities responsible for its payment within ten days. Payment of the allowance is terminated from the month following the month in which the changes occurred.
